The term ‘Royal Selection’ or ‘we’ or ‘us’ or ‘our’ refers to the owner of the Site. The term ‘you’ refers to the visitor, user or viewer of the Site.

When you use this Site you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with this Agreement. This license expressly prohibits you, without limitation, from reselling the Site or any portion thereof. You may use this Site for legitimate informational and shopping purposes only.

INTELLECTUAL PROPERTY

This Site and all of its contents, including, but not limited to, the website design, images, graphics, text, logos, all other trademarks, trade names, service names, any other source-identifying features, page headers, and scripts (collectively “Content”), is intellectual property owned by Royal Selection or the respective manufacturers. All Content that is not owned by us is displayed on this Site with permission of the respective Content owner. Your use of any Content without the written permission of the respective owner is strictly prohibited, except as provided in these Terms and Conditions of Use, and constitutes unlawful infringement of intellectual property rights in violation of international intellectual property laws. Please be aware that Royal Selection actively and aggressively enforces its intellectual property rights to the fullest extent of the law.

SITE SECURITY

You are prohibited from violating or attempting to violate the security of the Site. Actual or attempted unauthorized use of the Site or violations of system or network security may result in criminal and/or civil prosecution.

You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this Site. You may not harm the Site in any way or otherwise use the Site in any improper manner, including, but not limited to hacking into the Site's systems, spoofing or faking e-mail headers or slowing or stopping the functionality of the Site.

For our customer’s protection, we reserve the right to view, monitor and record any activities conducted on the Site without any notice and/or permission by you. Any information obtained by such proceeding is subject to our review and, if deemed necessary and permitted or required by law, to criminal and/or civil prosecution.

PRIVACY POLICY

Royal Selection is committed to protecting your privacy and security while you shop online. In the effort to assure you the best possible service, we have designated PayPal to collect our customers’ financial information – see the following section. We only collect personally identifiable information, like names and e-mail addresses, when voluntarily submitted by our visitors in the Contact Us form; we also collect our customer names, shipping addresses, e-mail addresses, and other optional contact information, as part of the purchase details we receive in the notifications from PayPal after successful checkout. Under any circumstances, unless required by law, we will NOT disclose, release, rent or sell your personal identifiable information to any other company or third party. We collect this information for the only purpose to be able to process your online order and to fulfill your specific request.

Royal Selection, upon receiving your express consent and permission, will occasionally send out emails to update you on new products, features, promotions, clearances and seasonal sales, reserving you the exclusive right to opt-out of this service at any time you like.

This site may use cookie and tracking technology depending on the features offered. Cookie and tracking technology are useful for tracking the number of visitors to the site, understanding their preferences, customizing the site to better meet their expectations and likes. By setting a cookie, users can browse, review our products, add items to the shopping cart, check out and order online, enjoying an enhanced and unique shopping experience. Usage of a cookie is in no way linked to any personally identifiable information while on our Site.

ONLINE PAYMENTS

The security of our customers’ financial information is our top priority. This is why we use PayPal for all of our online payments processing service. When our customers checkout, they will be redirected on a secure, PayPal-hosted page, where the purchase will take place. PayPal collects all of our customers’ financial information. This ensures that your credit card information remains totally secure being managed by a PCI DSS compliant service.

Payment Card Industry (PCI) Data Security Standard (DSS) is a set of comprehensive requirements for enhancing payment account data security established by American Express, Discover Financial Services, JCB International, MasterCard Worldwide, and Visa Inc. International. It was developed to help the broad adoption of consistent data security measures on a global basis. All merchants that process, store, or transmit payment card information for American Express, Discover, JCB, MasterCard, or Visa are required to be PCI DSS compliant.

Please note, all of our products are priced in Canadian dollars and each and every purchase or financial transaction initiated in our Site is in the same currency.

TAXES

Royal Selection operates in Ontario, Canada. Current law requires us to collect all applicable taxes based on the location address where the order will be shipped. Such taxes will be clearly displayed during the checkout process before final acceptance by you.

SHIPPING POLICY

Merchandise ordered and purchased at Royal Selection is shipped only to Canada and the United States. At our sole discretion we may use one of the following services:

ü  Canada Post Expedited Parcel;

ü  FedEx Ground;

ü  UPS Standard.

(We recommend checking the carriers’ websites for up to date transit time information).

In either case we apply a low $12.00 CAD flat rate, which will be clearly displayed as “shipping and handling fee” when checking out and it will be waived for net purchases (before taxes and fees) of $100.00 CAD and over.

Should you require a faster shipping service, please include your request with your order by using the tab “Add special instructions to the seller”, during the checkout process. A customer service representative will contact you as soon as possible (a) with a quote for the requested service (b) requesting further details if necessary.

After successful checkout, you will be given the opportunity to view and print your purchase’s receipt on a secure, PayPal-hosted page. PayPal will also send you a notification with all the transaction details to the e-mail address you provided during checkout.

Please note, each and every order is subject to our review and acceptance before any shipment will take place. More in particular, orders received before 5:00p.m. Eastern Time will be processed and shipped within the next two business days only in those cases of “confirmed address”. Should you request us to ship to an “unconfirmed address”, at our sole discretion and according to our continuous effort to maximize online financial transactions security, we may require additional verification or information before accepting your purchase. Please note, such security measure increases the order processing time, which must always be added to the transit time of the selected shipping service.

Once the merchandise has been shipped, you will be provided with a tracking number to check your order status online, and you will also receive notification(s) from the selected carrier. In your best interest, all of our shipments are fully insured at no cost to you!

Should you receive damaged, defective, or wrong merchandise, or should you be, for any reason, not completely satisfied with your purchase, please review our Return Policy for refunds, exchanges, or store credit.

ORDER CANCELLATION

Please note, there may be certain orders that we are unable to accept and must be cancelled. Royal Selection reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include, but are not limited to, insufficient quantities available for purchase, shipping address other than Canada or the United States, inaccuracies or error in product pricing, features, origin information, or problems identified as part of credit and fraud avoidance. Royal Selection may also require additional verification or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to process and accept your order. In case of refusal or cancellation, if a payment has already been processed (e.g., charge on your credit card), we will issue a refund for the full amount of the transaction (e.g., credit to your credit card in the amount of the charge).

RETURN POLICY

At Royal Selection the priority is you, our valuable customer. We are confident with the quality of our products and we are committed to guarantee your satisfaction with each and every purchase.

Should you want to make a return, we would greatly appreciate your cooperation in order to ensure you the best possible timely service. For each and every purchase, upon receipt of your order, please open the package immediately and inspect the contents for damage and/or manufacturing defects. For ease of processing and for the purpose of validating any eventual claim you may have, please do not refuse a shipment. Simply follow one of the three options made available to you, based on your specific situation.

1. In the case of damaged item(s) upon receipt, please report all damage claims to the shipper and to Royal Selection immediately and no later than 48 hours from receipt of your order. We kindly request photographic proof(s) to be sent for our records and to validate your claim. Upon receipt, review, and acceptance of the proof(s) submitted, we may either exchange your item(s) at no cost to you or, if not available for any reason (e.g., not currently in stock, discontinued item(s), etc.), issue, at your discretion, a refund or store credit in the amount of the original purchase price. With respect to the damaged item(s), we may request you to return it at no cost to you.

2. In the case of wrong or defective item(s) shipped to you, please report your claim to Royal Selection as soon as possible and no later than one week from receipt of your order. For claims received before 5:00p.m. Eastern Time, we will issue a Return Identification Number (RIN) within the next business day and e-mail it to you together with a return label. Please re-pack your item(s) in the original packaging and include a description with the reason for the return (type of defects, etc.). Include your full name and address to ensure a timely refund or exchange. Please note, the return shipment has to be post marked no later than four business days after a RIN has been issued, and the RIN must be on the shipping package. It is your responsibility to locate the selected carrier’s drop station nearest and most convenient to you. Upon receipt, inspection, and acceptance of your returned merchandise, we may either exchange your item(s) at no cost to you or, if not available for any reason (e.g., not currently in stock, discontinued item, etc.), issue, at your discretion, a refund or store credit in the amount of the original purchase price.

3. Finally, if for any reason you are not completely satisfied with your purchase, please report your claim to Royal Selection as soon as possible and no later than one week from receipt of your order. For claims received before 5:00p.m. Eastern Time, we will issue a Return Identification Number (RIN) within the next business day and e-mail it to you together with a return label. Please re-pack your item(s) in the original packaging and, at your own discretion, you may include a description with the reason for the return (what you did not like, etc.). Include your full name and address to ensure a timely refund or exchange. Please note, the return shipment has to be post marked no later than four business days after a RIN has been issued, and the RIN must be on the shipping package. It is your responsibility to locate the selected carrier’s drop station nearest and most convenient to you. Upon receipt, inspection, and acceptance of your returned merchandise, we will issue, at your discretion, a refund or store credit in the amount of the original purchase price less a $30.00 CAD restocking fee.

Please note, return(s) for which a RIN has not been issued, damaged for any other reason than that at point (1), not re-packaged with their original materials, not showing the RIN on the shipping package, or for which the timelines set out above have not been respected, will not be considered for refund, exchange, or store credit. In any case, no refund will be issued for return(s) received after 58 days from the purchase date. In such circumstances, exchange or store credit are the only available options.

Use of the Internet is solely at your own risk and is subject to all applicable local, provincial/state, national, and international laws and regulations. While committed to create a secure and reliable Site, Royal Selection and its affiliates are not responsible for the security of information transmitted via the Internet.

This Site is provided by Royal Selection on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of this Site. Some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If such laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you and you may have additional rights. If any of these terms or conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining terms or conditions.

GOVERNING LAW

This Site is owned and controlled by Royal Selection from its office located in the province of Ontario, Canada. Although this Site can be accessed from other locations, by accessing this Site, you agree that the statutes and laws of the province of Ontario, without regard to conflict of laws, will apply to all matters relating to use of this Site. In addition, any action or proceeding arising out of or related to this Terms and Conditions of Use or your use of this Site may be brought only in the province of Ontario, Canada. The failure of Royal Selection to act with respect to a breach of this Agreement by you or others does not constitute a waiver and shall not limit our rights with respect to such breach or any subsequent breaches.
